If a person dies without a Will there is a different procedure and authority to apply for in order to get the authority to deal with the deceased estate, called “Letters of Administration”. This is the equivalent of the Grant of Probate that is generally granted to the next of kin of the deceased.

Letters of administration give the Administrator the same rights and responsibilities that the executor has under a will. This person will apply for Letters of Administration (provided they are eligible as next of kin) and once granted,  collect in the assets, pay the debts and distribute the remainder of the funds in accordance with the legislation governing deceased estates where there is no will.

The Letters of Administration is generally a more complex process than Probate as the distribution is set by law and not by the deceased in a Will and the establishment of standing to make such an application must be clear at the beginning.
